General Terms and Conditions
1. Scope of Application
The present general terms and conditions - hereinafter called 'GTC' - apply to all legal transactions made through the dominique delice website and are aimed explicitly at the end user.
An end user is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed. A business user is a natural or legal person or a legal partnership who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional interest.
2. Contractual Partner, Conclusion of Contract
The purchase contract is concluded with Swiss Fashion Deluxe GmbH.
When the products are placed in the online shop, we are submitting a binding offer to conclude a contract for these items. You can initially place our products in the shopping basket without obligation and correct your entries at any one time before submitting your binding order by using the correction aids provided and explained in the order process. The contract is concluded when you click the order button to accept the offer for the goods in the shopping basket. Immediately after submitting the order, you will receive another confirmation by email.
3. Contract Language, Contract Text Storage
The language available for the conclusion of the contract is English. We save the contract text and send you the order data and our general terms and conditions by email. For security reasons, the text of the contract is no longer accessible over the internet.
4. Delivery Terms
In addition to the stated product prices, shipping costs may also apply. You can find more detailed provisions on any shipping costs incurred in the binding offer.
We only deliver by mail. Unfortunately, a self collection of the product is not possible.
We do not deliver to packing stations.
dominique delice's products are available in limited numbers, the customer acknowledges that availability must be checked at the time of purchase.
dominique delice reserves the right to change the products presented for sale on the website at any time and without prior notice.
5. Pre-order
The products offered on the website which can be pre-ordered and are not ready for immediate dispatch are expressly marked as "pre-order" and are displayed with the estimated delivery date.
The customer acknowledges and agrees that when he / she pre-orders the product, the price shown will be invoiced upon receipt of the confirmation email, regardless of whether the pre-ordered product is not yet ready for delivery at the said time. The pre-ordered product will be delivered to the customer according to the description on the product page on the expected date mentioned.
The customer acknowledges and agrees that the remaining articles of these general terms and conditions also apply to the products that have been ordered.
6. Payment
The following payment methods are generally available in our shop:
Credit Card
When you submit your order, you also provide us with your credit card details. After your verification as the legitimate cardholder, we will ask your credit card company to initiate the payment transaction immediately after the order has been placed. The payment transaction is carried out automatically by the credit card company and your card is charged.
PayPal
In the ordering process you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or register first, legitimise with your access data and confirm the payment instruction to us. After placing the order in the shop, we ask PayPal to initiate the payment transaction.
The payment transaction will be carried out automatically by PayPal immediately afterwards. You'll get more information during the ordering process.
7. Retention of Ownership
All ordered products remain the property of dominique delice until payment is received in full.
8. Transport Damage
If goods are delivered with obvious transport damage, please complain about such errors to the courier immediately and contact us as soon as possible. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to assert our own claims against the carrier or the transport insurance.
9. Warranty and Liability
Unless expressly agreed otherwise below, the statutory warranty regulations apply.
You have a 2-year warranty from the time of purchase. If the handbag is defective, please send us an email to info@dominique-delice.com. The warranty applies to manufacturing defects in the handbag's electronics, provided that these cannot be traced back to careless handling by the buyer. Any damage caused by improper use is not covered by the warranty.
Batteries and rechargeable batteries are excluded from the warranty.
Outside the warranty period, repair work can be invoiced.
Information on any applicable additional guarantees and their exact conditions can be found with the product and on special information pages in the online shop.
In addition, claims for any other resulting damages are excluded.
10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here https://ec.europa.eu/consumers/odr/.
We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
11. Data Privacy Protection
The privacy statement is an integral part of these GTC. By accepting these GTC, customers also agree to the privacy statement.
12. Place of Jurisdiction and Applicable Law
All legal relations between dominique delice and its customers are subject to applicable Swiss law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
For any claims resulting from purchase contracts in which one party is dominique delice, the exclusive place of jurisdiction is Zürich.
